The properties known as "Quistinic" (Quistin, Chestnut, Chataigne or Walnut) are offered for holiday rental subject to confirmation by Mr David Furnival ("the Owner") to the renter ("the Client").

1.     To reserve the Property, the Client should complete and sign the booking form and return it together with payment of the initial non-refundable deposit (25% of the total rent due). Following the receipt of the booking form and deposit, the Owner will send a letter confirming the details. This is the formal acceptance of the booking.

2.     The balance of the rent together with the Security Deposit (see Clause 5)       is payable not less than 8 weeks before the start of the rental period. If payment is not received by the due date the Owner reserves the right to give notice in writing that the reservation is cancelled. Reservations made within 8 weeks of the start of the rental period require full payment at the time of booking. The balance of the rent and the Security Deposit should be paid by separate cheques.

3.     CANCELLATIONS. All cancellations must be notified to Mr David Furnival in writing. Telephone cancellations will not be accepted. The date of receipt of the cancellation notice will be deemed to be the date of cancellation. If you cancel your booking you will be liable to pay the following charges:

   o  8 weeks or more before commencement of the booking - initial deposit

          o      6 - 8 weeks before commencement of the booking - 50% of full accommodation cost

   o    Less than 6 weeks before commencement of the booking - full accommodation cost.

4.     A Security Deposit of £200 for every week or part week of the rental period is required in case of, for example, damage to the property or its contents. However, the sum reserved by this clause shall not limit the Client’s liability to the Owner. The Owner will account to the Client for the Security Deposit and refund the balance due within two weeks after the end of the rental period. (Please note that this Security Deposit will be banked). Subject to Clauses 2 & 5 above in the event of a non-insurable cancellations, refunds of amounts paid will be made if the Owner is able to relet the "property" and any expenses or losses incurred in so doing will be deducted from the refundable amounts. The Client is strongly recommended to arrange a comprehensive travel insurance policy (including cancellation cover) and to have full cover for the party’s personal belongings, public liability etc. since these are not covered on the Owner’s insurance.

5.     The rental period shall commence at 4.00pm on the first day and finish at 10.00am on the last day. The Owner shall not be obliged to offer the accommodation before the time stated and the Client shall not be entitled to remain in occupation after the time stated.

6.     The maximum number to reside in the "Property" must not exceed 10 in Chestnut, 6 in Walnut and Chataigne, and 4 in Quistin unless the Owner has given written permission.

7.     The Client agrees to be a considerate tenant and to take good care of the "Property" and to leave it in a clean and tidy condition at the end of the rental period. The Owner reserves the right to make retention from the Security Deposit to cover cleaning costs if the Client leaves the "Property" in an unacceptable condition. The Client agrees not to act in any way which would cause disturbance to those residents in neighbouring properties.

8.     The Client shall report to the Owner without delay any defects in the "Property" or breakdown in the equipment, plant, machinery or appliances in the "Property" and garden. Arrangements for repair and/or replacement will be made as soon as possible. The Owner shall not be liable to the Client:

        o    For any temporary defect or stoppage in the supply of public services to the "Property", nor in respect of any equipment, plant, machinery or appliances in the "Property" or garden.

    o    For any loss, damage or inconvenience caused to or suffered by Clients if the "Property" shall be destroyed or substantially damaged before the start of the rental period and in any event, the Owner shall within 7 days of notification refund to the Client all sums previously paid in respect of any rental period.

         o    For any loss, damage or injury which is the result of adverse weather conditions, riot, war, strikes or other matters beyond the control of the Owner.

         o    Under no circumstances shall the Owner’s liability to the Client exceed the amount paid to the Owner for the rental period.

This contract shall be governed by English Law in every particular including formation and interpretation and shall be deemed to have been made in England. Any proceedings arising out of or in connection with this contract may be brought in any court of competent jurisdiction in England.

THE SWIMMING POOL TERMS & CONDITIONS

The pool is 10m x 5m with steps at the shallow end, being 1m deep and the far end 1.40m. The pool is fenced with access via a gate. The pool has a patio area containing poolside furniture. The swimming pool is open between the hours of 10.00am - 9.00pm everyday. Although our pool is for private use by us and our guests, under French Law, because it is used by paying guests, it is considered to be a “public pool” and is therefore, governed by the same regulations as a public swimming pool. Recently introduced legislation is very strict, although mostly a matter of common sense. As gites owners, we are legally required to adhere to relevant rules concerning its use and to point out the same to our guests.

1.             Absolutely no breakables i.e. glass, bottles, china or potteries are not to be taken inside the pool area.

2.             The gate must be kept closed at all times and should not be opened for other people's children unless prior permission has been given by their parent/guardian.

 No children under the age of 12 or non-swimmers will be allowed in this area unless under supervision of a responsible adult. Furthermore, parents/guardians must accept full responsibility at all times for the constant supervision, safety and care of their children and any non-swimmers when in the vicinity of, or using the swimming pool.

3.             No large inflatables other then the normal swimming aids such as rings and armbands allowed.

4..             Absolutely no consumables (other than plastic bottles of water) allowed poolside. Spillages will attract ants and vermin. The consumption of food, drink, crisps and sweets etc. must be restricted to outside the pool area.

5.             Excessive use of suntan cream/oil can have a disturbing effect on the quality of the water, which ma result in the pool being closed down for extra cleaning. We would ask that such products are “towelled off” before entering the water, and re-applied after swimming. Should you wish your child to wear a T-Shirt whilst swimming, this must be dye-proof (white preferably). Only appropriate swimwear should be worn (i.e. not cut off jeans etc.) Such garments are forbidden in French swimming pools.

6.            The pool must be accessed and exited by the pathway leading to a paved area (where there is provision for footwear to be left), and not by climbing over the fence and walls. Grit taken into the swimming area may result in the filtration system being contaminated. Please do not allow children to throw gravel or any other sharp object or toy into the water which might damage the pool liner, or block the filtration system and may result in the closure of the pool for cleaning/repair purposes.

7.         The Owners reserve the right to close the pool for cleaning purposes due to adverse weather conditions, excessive use of oils and creams, or other matters beyond the control of the Owners.

8.          The Owners shall not be liable to the Clients using the swimming pool and as such is used entirely at the Clients' own risk.

9.             The Owners reserve the right to ask anyone found contravening these regulations to leave the pool area - exceptions will not be made.
